Definition
The company is referred as “FallHost.com“, “FH”, “us” and “we”. The customer will
be referred to as “you”, the “client” or the “customer”. The products will be referred
as “Services” and “Products”. By making an account or purchasing a service on
fallhost.com, you agree to the Terms of Service (TOS) and our Privacy Policy.
Section 1: Age Restrictions
i: Minimum age on ordering a service
The client must be at least thirteen (13) years of age in order to purchase any
service on the website of fallhost.com. If the client is below the age of thirteen (13),
they will not be able to make a purchase on any of the services provided by
FallHost.com.
ii: Minimum age on registering an account
The client must be at least thirteen (13) years of age in order to register an account
on our website due the Children’s Online Privacy Protection Act (COPPA) that’s
being enforced by the Federal Trade Commission (FTC). If the client is below the
age of thirteen (13), he or she needs permission from a parent or guardian in order
to register an account on FallHost.com.
Section 2: Refund & Cancellations
i: Refunds for Shared Services (Gameserver Panel Servers)
FallHost.com enforces a twenty-four (24) hours no-questions-asked refund policy on
your first invoice for Game Server Panel Servers. If the client is unhappy with the
service provided, regardless of the specified reason, then they will receive a full
refund on the PayPal account of which service was bought with if a cancellation
request is submitted within twenty-four (24) hours. Any longer will result in no refund.
The only authorised members of the management team who can carry out elevated
refunds are the managing directors and their decision is final.
ii: Cancellations
Cancellation requests must be submitted within the client area within at least
forty-eight (48) hours. If a cancellation request is not submitted within this
timeframe in the client area, it will not be processed.
Section 3: Improper usage & effecting the network negatively
i: Misuse of services
If the client is attempting to use the service in a way that it is harmful to our systems,
it will result in an immediate termination of the service and account without any
warning. Using the services of FallHost.com in a wrongful way will lead to
termination of the service with an upfront warning, this applies to the following:
i1: General Terms:
All details must be valid in the client area. This includes, but not limited to, the
clients full name, email address, postal address and location. The client must
not enter fake or misleading information. FallHost.com has the right to
terminate any purchased/ordered services until this has been rectified.
The client is not allowed to use someone else’s personal information to register
an account on FallHost.com. This is against the law of Identity Theft Penalty
Enhancement Act that’s being enforced by the Federal Trade Commission
(FTC). If the client is using false personal information in order to register an
account, the client has eighty-four (48) hours to change this to their own
credentials after receiving a notification. If this is not done within that time
period, the client’s account and service will be terminated. FallHost takes no
liability and provides no warranties that once a server is suspended, the files
will be accessible by yourself or your third parties.
i2: Discord Terms:
Clients must not direct message clients or staff advertising messages and this is
strictly prohibited. If the client acts on this, they will be permanently removed from
the Discord lounge and their services terminated. There are designated
advertising channels for clients to promote their hosting with us.
i3: Gameserver Panel Terms:
Using any RAM exploits or creating alternate accounts (Alts) to bypass certain
features will get your IP address banned from FallHost.com.
CPU abuse will result to a warn or a suspension. Our servers are limited to
set CPUs for different game servers. Ask us for more information. Hosting
botnet's, DDoS setups and other malicious code is prohibited and action will
be taken immediately.
Minecraft: Using sub servers is prohibited and action will be taken immediately.
This includes plugins such as SubServers from the spigot. Minecraft: Using
cracked, leaked or blacklisted plugins from sites such as Black Spigot will result
in a 24-hour suspension to rectify the problem, then an immediate termination of
services.
Minecraft: Bungeecord and multi-instance hosting is not allowed for free
servers. You will need to purchase at least 2 servers from us before enabling
bungee. (Free servers may then be linked to this)
i4: Financial Terms:
Chargebacks are prohibited and will get you immediately blacklisted on our
network.
i5: Other Terms:
You cannot host instant download links, pornographic or racist content,
purchase a service from us for solely storage purposes and host illegal,
leaked or illegitimate mods, plugins and content.
Hyperlinking any link that affiliates with FallHost.com is not allowed without
our consent. Organizations with our consent may link our website on
platforms and websites that we have approved, as longs as the link is not
misleading in any way and does not falsely imply sponsorship and
partnership.
Whatever client role you are in, you as a client still need to abide by our
terms and rules. Failure to do so will get your service terminated without
any refunds.
Section 4: Service Level Agreement (SLA) Terms & Data Loss
i: Data Loss
FallHost.com is not responsible for the data loss on the client’s service or services.
The customer is responsible for making their own backups. If the client failed to pay
the overdue invoice and the service gets automatically terminated, we are not
responsible for the data loss upon this event. We are not responsible for any data
loss on trial servers (If applicable).
ii: Service Level Agreement (SLA)
Support Team Time:
Our SLA for a Support Team member to respond is forty-eight (48) hours, but this
will be much less in most cases. If the Support Team has not made a contact within
this time, then the client can contact the management team to discuss the most
appropriate action.
iii: Overdue Payments
The customer has five (5) days to submit an overdue payment before the service has
a 10% late fee applied to the due invoice. If the service is still not paid within seven
(7) days, then the service is suspended. If a service gets suspended, and payment is
made, the service will be automatically restored. If payment is not made within thirty
(30) days of the overdue invoice, the service will be automatically terminated.
The company takes no responsibility and assumes no liability for any user
content that you or any other user or third party posts or transmits using our
images, products or services. You understand and agree that you may be
exposed to user content that is inaccurate, objectionable, inappropriate for
children, or otherwise unsuited to your purpose
iv: Changes of the Terms of Service (“ToS”)
FallHost.com has the right to change the Terms of Service at any time. The client
will be notified through email & notified on Discord about the changes in the
Terms of Service.
CLIENT ACCOUNT TERMS
a. By opening a client account, the client accepts the following responsibility and
liability agreement:
i. I will not share my account credentials, regardless of subjective use proposals
(“agreements of how or when to use the account”) outside of my supervision and
thorough control.
ii. I will take primary responsibility of all actions in relation to my accounts with the
company.
iii. I will, on time and efficiently, ensure to pay any monthly costs in relation to
invoices on my account.
iv. I will take full liability for any actions performed on my account if the account is
not properly secured.
v. I will not attempt to circumvent security measures employed to secure any part
of the companies network or services the company is responsible for.
vi. I will not, under any circumstances, breach any clause within this agreement.
vii. I will not perform any such activity which is considered illegal under the legal
governance of this agreement, or the country in which I reside.
viii. The company takes no responsibility and assumes no liability for any user
content that you or any other user or third party posts or transmits using our
images, products or services. You understand and agree that you may be
exposed to user content that is inaccurate, objectionable, inappropriate for
children, or otherwise unsuited to your purpose
